On Monday, 20th May, 2024, the Atheists In Kenya Society appeared in court to face a legal challenge brought by Stephen Ndichu, a former MP and Kiambu County government chairman. The case was filed in the High Court in 2022. The matter was presided over by Justice Lawrence Mugambi. Ndichu is seeking a declaration that the registration of the society is unconstitutional.

As the plaintiff, Ndichu argues that the registration of the Atheists In Kenya Society violates Kenya’s constitutional principles, citing in particular the Preamble to the Constitution. We are vigorously defending our right to be recognised as a legitimate organisation.

The final hearing of the case is scheduled for 22 July 2024.

The outcome of this case has the potential to set an important precedent for the legal status of atheist, humanist and secular groups in Kenya.
